Chapter 1 General Provisions
Article 1 (Purpose)
The purpose of these Terms of Service is to stipulate the terms and procedures of service use, rights, obligations, responsibilities, and other necessary matters between "SuperDaddy" (hereinafter referred to as the "Company") and the user (or member) in relation to the use of the "Tenb" service (hereinafter referred to as the "Service") provided by the Company.
Article 2 (Definition of Terms)
The definitions of the terms used in these Terms of Service are as follows. The interpretation of undefined terms shall be in accordance with relevant laws and regulations and the distinct service guides.
- Service: Refers to the "Tenb" website and the integrated social marketing platform-based services provided by the Company.
- Member: Refers to a customer who accesses the Company's Service, completes registration according to these Terms, and uses the Service provided by the Company.
- Member Information: Refers to mandatory or optional input information designated by the Company to use the Service, which the Member can directly manage through the settings screen within the Service.
- Content: Refers to all information such as signs (including URLs), texts, images (including photos), and files posted by the Member within the Service.
- Paid Service: Refers to premium payment-based functions and related services provided by the Company for a separate fee.
- Standard Subscription: Refers to the method by which usage fees are regularly billed and automatically renewed on a monthly/yearly basis via the payment method registered by the Member for Paid Services.
- Credit: Refers to virtual currency (points) charged and deducted by the Member to use certain charge-based functions within the Service, such as Instagram DM automated replies, notification messages, and AI text/image generation.
Article 3 (Effect and Revision of Terms)
- These Terms become effective by being posted on the Service screen so that Members can easily understand them.
- The Company may revise these Terms within the scope that does not violate relevant laws. In case of revision, the effective date and reasons for revision will be specified and posted along with the current Terms from 7 days prior to the effective date. However, changes that significantly affect the rights or obligations of Members will be posted 30 days in advance and notified to the Member via email.
- If the Member does not explicitly express refusal within the specified refusal period while the Company announces or notifies the revised Terms, the Member shall be deemed to have agreed. If the Member does not agree to the changed Terms, they may discontinue use and terminate the membership.
Article 4 (Rules Outside the Terms)
Matters not specified in these Terms shall be governed by relevant laws or detailed service usage guidelines established by the Company.
Chapter 2 Service Use Contract and Member Management
Article 5 (Establishment and Limitation of Registration)
- Registration is established when the user agrees to these Terms and the Privacy Policy, and completes the procedures set by the Company such as social login.
- Age Restriction: Only those aged 14 or older are eligible to apply for and use this Service.
- The Company may restrict registration or terminate the contract (forced withdrawal) after the fact in the following cases:
- Using someone else's name or email
- Having previously lost membership status due to reasons such as violating these Terms
- If it is determined that the Service cannot be normally used due to inappropriate purposes such as spam or abusing
Article 6 (Change of Member Information and Responsibility for Account Management)
- Members can view and modify their personal information at any time through the Service. Disadvantages resulting from not modifying changed information are borne by the Member.
- The Member is solely responsible for consequences arising from negligence in managing accounts (social login credentials, API integration tokens, etc.) and unauthorized use. If the Member recognizes that someone else has stolen their account, they must notify the Company immediately.
Chapter 3 Provision and Operation of Service
Article 7 (Provision and Change of Service)
The Company provides functions such as building profile webpages and integrating social marketing tools. The Company may modify, temporarily suspend, or terminate all or part of the provided Service due to inevitable operational or technical needs, in which case it will announce this in advance.
Article 8 (Management of Content and Ownership of Rights)
- The copyright of the Content posted by the Member on the Service belongs to the Member. However, Content set to public by the Member may be partially reproduced or exposed for service search results and operational promotion purposes.
- The Company may sanction, hide, or delete a Member's Content without prior notice if it is determined to violate related laws or community guidelines such as defamation, intellectual property infringement, spam, and illegal gambling.
- Platform Ownership: All intellectual property rights for the Service, such as templates, code, UI/UX created/developed by the Company itself, belong entirely to the Company. Members may only use the Service within the license granted by the Company, and cannot illegally copy, lease, or sell it.
Article 9 (Provision of Information and Posting of Ads)
The Company may post advertisements of partners within the Service screen in connection with the operation of the Service. In addition, with the explicit consent of the Member, the Company may send useful information and advertising mobile messages through channels such as email and notification talk, and the Member can opt out of receiving them at any time.
Article 10 (Obligations of the Company and Members)
Obligations of the Company: The Company does its best to provide continuous and stable Service, and complies with strong security policies to protect personal information.
Obligations of Members: Members must not engage in illegal/unfair acts when using the Service, and massive sending of spam messages, interference with others' services, and platform vulnerability attacks (hacking/reverse engineering) are strictly prohibited.
Article 10-2 (Restrictions on Use of AI Voice Synthesis)
- The Company provides artificial intelligence voice synthesis (TTS) features through the Service and its desktop application. Some of these features use publicly released AI models that run directly on the Member's own device. Such models are governed by separate licenses established by third parties, and the Company provides notice of those terms through the notice screen within the application and through notice files placed in the model installation folder.
- Members may not use these features, or any voice output generated through them, for any of the following purposes:
- Any act that violates applicable laws or infringes the rights of others
- Creating or distributing content that exploits or harms minors
- Generating or disseminating false information for the purpose of causing harm to others
- Impersonating the voice of a specific individual without proper consent, or generating or distributing voice output likely to be mistaken for the speech of a specific individual
- Presenting synthesized speech as the speech of a real person while concealing the fact that it was generated by artificial intelligence
- Use for the purpose of defaming or harassing any individual
- Use in automated decision-making that affects an individual's legal rights or entitlements
- Discriminating against individuals or groups on the basis of online or offline behavior, personal characteristics, or legally protected categories (such as race, gender, religion, or disability)
- Exploiting vulnerabilities of a specific group based on age or social, physical, or mental characteristics in a manner that materially distorts behavior so as to cause or be likely to cause physical or psychological harm
- Providing medical advice or interpreting medical results
- Use for predictive profiling in the administration of justice, law enforcement, immigration, or asylum processes
- Where a Member redistributes these features or the models used therein to any third party, or provides a service based upon them, the Member must impose upon that third party, as a contractual obligation, restrictions identical to those set out in Paragraph 2 of this Article.
- The right to use voice output generated through these features belongs to the Member who generated it. Neither the Company nor the original authors of the models assert any rights over the output itself. However, responsibility for the content of the output and for its subsequent use rests with the Member who generated and used it.
- These features are provided "as is," and the Company makes no warranty as to the pronunciation, intonation, accuracy, or fitness for any particular purpose of the synthesized voice.
- If a Member violates this Article, the Company may restrict use of the relevant feature without prior notice, or suspend or terminate membership pursuant to Articles 5 and 6, and the Member shall bear any legal liability arising from such violation.
Chapter 4 Paid Services and Credits (Payment and Refund)
Article 11 (Paid Regular Subscription and Billing)
- Regular subscription Paid Services are billed and automatically renewed to the pre-registered payment method at the specified cycle (monthly or yearly) until canceled, calculated from the date of purchase.
- In the event of non-payment or arrears of usage fees, the Company may temporarily limit access to Paid Services or automatically terminate the subscription.
Article 12 (Credit Recharge and Automatic Expiration Policy)
- Credits are unit currencies consumed when using automated functions (AI, notification talk sending, etc.) within the Service, and can be recharged (purchased) through payment methods.
- Expiration Date: The validity period of charged paid Credits is 5 years from the date of payment. Unused Credits that have passed 5 years are automatically expired according to commercial law extinctive prescription provisions. For Credits provided free of charge, such as via events, they are subject to separately notified deadlines.
- Withdrawal Process: If a Member voluntarily withdraws (arbitrary withdrawal) or is forcibly withdrawn according to the Terms due to abusing, etc., all remaining Credits in the deleted account immediately expire automatically and are not refunded in cash afterward or transferred/restored to another account.
Article 13 (Cancellation, Refunds, and Payment Processing)
Payments for paid services may be processed via bank transfer or through external sales channels operated by the Company, such as Naver Smart Store. For transactions made through an external sales channel, payment processing, invoicing, and cancellation or refund procedures are also subject to the terms and policies of that channel. Detailed conditions regarding the cancellation and refund of subscriptions and credits are governed by our separate Refund Policy.
Chapter 5 Third-Party Integrations, Indemnification, and Dispute Resolution
Article 15 (Instagram API Integration & External Platform Exemption)
This Service integrates external social APIs (Instagram) provided by Meta Platforms, Inc. ("Meta") to offer automated functions. The Company (Tenb) is not in an official partnership or warranty relationship with Meta. Members MUST adhere to Instagram Terms of Use and Community Guidelines when using platform integration features. Any account restrictions or legal disadvantages caused by violations of regulations such as Spam policies and infringement of others' rights are entirely the responsibility of the Member, and the Company expressly disclaims any legal liability for them.
Article 15-2 (Use of YouTube API Services)
- The YouTube channel integration and video publishing features of this Service are provided using YouTube API Services.
- By using the YouTube integration features of this Service, Members are agreeing to be bound by the YouTube Terms of Service. The Google Privacy Policy also applies to such Members.
- Members may revoke the access granted to this Service at any time via the Google security settings page.
- This Service is an editing tool by which the Member edits each video, reviews it individually, and publishes it by their own action. The Company does not upload any video without the Member's explicit action, and does not modify or delete the Member's videos.
- Members must not use these features for purposes that violate the YouTube Community Guidelines or the YouTube API Services Terms of Service, including repetitive posting of identical or substantially similar videos, automated bulk uploading, or unauthorized posting of another party's copyrighted works. Where such use is confirmed, the Company may restrict that Member's use of the integration features.
- The Company (Tenb) is not in an official partnership or endorsement relationship with Google LLC or YouTube. Any channel restriction, video privacy lock, account suspension, or other disadvantage arising from a Member's violation of the applicable terms or policies is entirely the responsibility of the Member, and the Company bears no legal liability for it.
Article 15-3 (TikTok API Integration & External Platform Exemption)
This Service integrates an external API provided by TikTok Pte. Ltd. ("TikTok") to offer video transfer functions. The Company (Tenb) is not in an official partnership or warranty relationship with TikTok. Members must adhere to the TikTok Terms of Service and Community Guidelines when using the integration features. Any account restrictions or legal disadvantages caused by violations are entirely the responsibility of the Member.
Article 16 (General Exemption)
- The Company is exempt from liability for service interruptions if the Service cannot be provided due to natural disasters or force majeure beyond the Company's control, such as national emergencies, changes in laws, paralysis of major telecommunications networks, or unforeseeable hacking attacks.
- The Company is not liable if account data is damaged or business profit loss occurs due to the Member's device or network environment.
- The Company is not obligated to intervene in communication and commercial disputes between Members or between a Member and a third party mediated by Tenb, and has no liability to compensate for any resulting damages.
Article 17 (Compensation for Damages and Jurisdiction)
- If the Company or either party severely violates the Terms and causes damages to the other party due to their own fault, the victim may claim damages against the infringing party. However, unless the Company has intentional misconduct or gross negligence, the Company's liability may be limited.
- If a dispute arises between the Company and the Member regarding the use of this Service, both parties will sincerely consult for dispute resolution.
- If a civil lawsuit is filed due to failure to reach an agreement, these Terms shall be governed by the laws of the Republic of Korea, and the district court governing the Company's head office shall be designated as the exclusive competent court of first instance.
